April isn’t starting off any better than March ended for Currituck County.

Judith Ayers had been employed with DSS from 2007 until the incident in 2017. Ayers was the supervisor for the Child Protective Services Unit at DSS who reported directly to the DSS Director. Ayers consistently received positive work performance reviews and had never been disciplined as a DSS employee before the incident occurred. Ayers was terminated in June 2018, for making an inappropriate comment about a client. Administrative Law Judge Melissa Owens Lassiter in the Office of Administrative Hearings, had previously decided in favor of Ayers on January 31, 2023. The county appealed.

Judge Hunter Murphy wrote in the majority opinion, “Here, we hold the ALJ’s findings of fact, to the extent necessary for the ultimate just cause determination, were supported by substantial evidence in the record. We further hold, upon de novo review, that there was no error in the ALJ’s determination that DSS lacked just cause to dismiss Ayers for her single instance of UPC in light of the facts and circumstances of this case. Accordingly, we affirm the ALJ’s final decision to retroactively reinstate Ayers with back pay and attorneys’ fees, subject to a two-week suspension without pay and subject to her taking additional cultural diversity and racial sensitivity training.”

    Unrelated to this story, however, isn’t there a time requirement for board meeting agendas to be posted ie. Currituck County Planning Board, April 4, 2024, Special Meeting and for their April 9, 2024 meeting?

    Also, it appears the April 4th Special Meeting may have been cancelled, but I have not found a notification of the cancellation.

    I am monitoring a Special Use permit, possible submittal, that may demonstrate a familial conflict of interest, favoritism or just out right bias.

    An additional comment/concern, I have tried to be observant of the UDO modification requests that may effect the criteria for Special Use permit requirements.

    Thank you for your reporting. I was aware of the “good ole boys club” here in Currituck, but the extent of corruption you have brought to light, far exceeds what I imagined. Prime example of abuse of authority and power by incompetent individuals, for personal gain.

    One other comment about the Judith Ayers case: she was fired in November, 2017. Also, if you are interested, it would be very helpful to read Judge Melissa Lassiter’s 2nd court order. The first appeal court sent the case back to Judge Lassiter after her initial finding in the favor of Judith Ayers, so that Currituck DSS ‘s Samantha Hurd could have another chance to re-do her initial investigation so that Hurd could include any possible ACTUAL damage that Ayers had done to DSS by Ayers’ action, for which she was fired. This was 5 (yes five) years after Ayers was dismissed. The court order that Judge Lassiter wrote resulting from the court hearing after Director Hurd conducted her investigation to see if Ayers had caused damage to Currituck DSS was way more specific than the first order. I will be glad to look up the date of Judge Lassiter’s order and get back with youl

    I was wrong about the court order of Judge Lassiter’s report refererenced in a previous comment, being on the NC Court of appeals website. I have it, and will send a copy of it as soon as I am able.

    The reason I think you should have so much interest in this case is that I believe (with good reason) that Currituck County will AGAIN appeal this ruling within 30 days. I will get the last court order from Judge Lassiteer to you as soon as I can figure out how to do it. Should be by the end of the day or earlier.
